Terms of Service

1. Eligibility

You must be at least 18 years old, or 13 or older with the consent and supervision of a parent or legal guardian, to use the Service. The Service is not directed to children under 13, and we do not knowingly collect information from them. By using the Service you represent that you meet these requirements.

2. The Service

RouteCaster helps you plan driving routes and overlays weather, road, fuel, and point-of-interest information to assist your trip planning. Features, data sources, and availability may change over time. Some features require a paid subscription.

3. Safety Disclaimer — Please Read

RouteCaster is a planning aid, not a real-time safety system or a substitute for your own judgment. Routing, traffic, fuel, and weather information may be incomplete, delayed, or inaccurate, and is provided for general planning purposes only. It is not a substitute for official weather advisories, road-closure notices, emergency alerts, or the instructions of law-enforcement and emergency personnel.

Do not interact with the Service while operating a vehicle. Always follow applicable traffic laws, observe actual road and weather conditions, and make your own decisions about whether and how to travel. You are solely responsible for your safety and the safety of your passengers. Never rely on RouteCaster to avoid severe weather or hazardous conditions.

4. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. Provide accurate information, keep it current, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, Billing, and Cancellation

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel. Prices are shown at checkout and may change with notice for future billing periods.

You may cancel at any time from your account settings; cancellation takes effect at the end of your current billing period, and you retain access until then. Except where required by law, payments are non-refundable and partial periods are not prorated. If a payment fails, we may downgrade or suspend paid features.

6. Acceptable Use

You agree not to:

• use the Service unlawfully or in violation of these Terms;
• access, scrape, or overload our APIs or infrastructure, or attempt to exceed rate limits;
• reverse engineer, resell, or create derivative services from the Service without permission;
• upload unlawful, infringing, harmful, or malicious content;
• attempt to access other users' data or accounts, or interfere with the Service's security.

7. Intellectual Property

The Service, including its software, design, and content (excluding your own content and third-party data), is owned by RouteCaster.app LLC and protected by intellectual-property laws. Patent pending. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of content you submit and grant us a license to use it solely to operate and improve the Service.

8. Third-Party Services

The Service relies on third parties including Mapbox (mapping and routing), weather data providers, fuel-price providers, and Stripe (payments). Your use of features powered by these providers may be subject to their terms, and we are not responsible for their content, accuracy, or availability.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any information will be accurate or complete.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTECASTER.APP LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

11. Indemnification

You agree to indemnify and hold harmless RouteCaster.app LLC from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

13. Governing Law

These Terms are governed by the laws of the State of South Dakota, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in South Dakota for any dispute not subject to arbitration or small-claims resolution.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or in the Service. Your continued use after changes become effective constitutes acceptance.
